1. Acceptance of Terms
By downloading, installing, or using the ChalSaath mobile application ("App"), you agree to be bound by these Terms & Conditions. If you do not agree, please do not use the App. These terms constitute a legally binding agreement between you and Ctrl Shift Solutions ("Company", "we", "us").
2. Eligibility
- You must be at least 18 years of age to use ChalSaath.
- You must provide accurate and truthful personal information during registration.
- You must possess a valid Indian mobile number for account verification.
- Car Owners must hold a valid Indian driving licence and vehicle registration certificate.
3. Nature of the Platform
ChalSaath is an IT Intermediary under the Information Technology Act, 2000 (India). We provide a peer-to-peer carpooling platform that connects Car Owners (drivers) with Riders (passengers) travelling in the same direction. ChalSaath does NOT employ drivers, own vehicles, or operate transportation services. All rides are privately arranged between users.
4. Car Owner Obligations
- Publish only rides you genuinely intend to complete.
- Ensure your vehicle is roadworthy and properly insured.
- Carry a valid driving licence at all times during rides.
- Do not overcharge Riders — pricing must reflect cost-sharing, not commercial profit.
- Do not cancel rides without reasonable cause, especially close to departure time.
- Treat all Riders with respect and maintain a safe ride environment.
5. Rider Obligations
- Be at the agreed pickup point on time.
- Treat Car Owners and fellow Riders with respect.
- Do not request route deviations not agreed upon during booking.
- Cancel bookings promptly if you cannot attend — repeated last-minute cancellations will result in penalties.
- Share only accurate information about yourself and your travel requirements.
6. Prohibited Conduct
The following are strictly prohibited on ChalSaath:
- Using the platform for commercial taxi or auto-rickshaw services.
- Harassment, discrimination, or abuse of any user.
- Providing false information or impersonating another person.
- Attempting to circumvent safety features, KYC verification, or platform policies.
- Spam posting rides (creating and immediately cancelling rides to manipulate search results).
- Any activity that violates applicable Indian law.
7. Safety
- ChalSaath verifies user identities via KYC and live photo verification — but we cannot guarantee the conduct of any user.
- We strongly recommend sharing your trip details with a trusted contact before travelling.
- Use the in-app SOS feature in emergencies.
- Do not share financial information, passwords, or sensitive personal data via in-app chat.
- ChalSaath is not liable for any loss, injury, or damage occurring during a ride.
8. Cancellation & Penalty Policy
- Riders: Cancellations more than 24 hours before departure — free. Between 2–24 hours — minor trust score deduction. Within 2 hours — significant trust score deduction. Three strikes result in a 7-day account suspension.
- Car Owners: Cancellations within 2 hours of departure result in a 24-hour ride publishing suspension and trust score deduction. Completing a ride immediately lifts any active publish suspension.
9. Trust Score & Ratings
ChalSaath calculates a Trust Score for every user based on their average rating, ride completion rate, and cancellation history. Trust Scores are displayed publicly on user profiles. Users can rate each other after every completed ride. Ratings must be honest and based on genuine experience — false or retaliatory ratings violate these Terms.
10. Account Suspension & Termination
ChalSaath reserves the right to suspend or permanently terminate any account that:
- Violates these Terms & Conditions.
- Receives multiple safety complaints from other users.
- Fails KYC verification or provides fraudulent documents.
- Engages in spam or platform manipulation.
Suspended users may appeal to support@chalsaath.com within 30 days.
11. Intellectual Property
All content, design, code, trademarks, and branding of ChalSaath are the exclusive property of Ctrl Shift Solutions. You may not copy, reproduce, distribute, or create derivative works without our written permission.
12. Limitation of Liability
ChalSaath provides the platform "as is" without warranties of any kind. To the fullest extent permitted by law, Ctrl Shift Solutions shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from your use of the platform, including but not limited to losses resulting from ride cancellations, accidents, personal injury, or data loss.
13. Governing Law & Dispute Resolution
These Terms are governed by the laws of India. Any disputes arising from the use of ChalSaath shall be subject to the exclusive jurisdiction of the courts of India. We encourage users to first contact us at support@chalsaath.com to resolve disputes amicably before pursuing legal action.
14. Changes to Terms
We may update these Terms from time to time. Material changes will be notified via in-app notification. Continued use of ChalSaath after the effective date of any change constitutes acceptance of the revised Terms.
